SEC Chair Paul Atkins said the agency plans to provide greater clarity on rules governing on-chain fundraising using its existing statutory authority, even as Congress remains deadlocked on broader legislation. The U.S. Senate on Sept. 15 failed to advance the CLARITY Act, with the measure falling 49–50 and short of the 60-vote threshold needed to move forward. Atkins has not said whether the SEC's upcoming direction will come through exemptions, new registration routes, or staff-level guidance. The SEC has recently issued a series of crypto-related updates. On Sept. 17, the agency took steps that market participants viewed as opening the door to tokenized stocks. On Sept. 25, it published nine FAQs addressing how token issuers' commitments may influence whether an asset is treated as a security. Commissioner Hester Peirce is set to leave on Oct. 2. Her departure would leave Atkins and Mark Uyeda as the SEC's only sitting commissioners.
