Lummis Says CLARITY Act Failure Could Bring ‘Regulatory Dark Ages’ for US Devs

Sen. Cynthia Lummis warned on May 27, 2026 that if the CLARITY Act does not pass in this congressional session, U.S. software developers could again face prosecution simply for publishing code. She said the outcome would amount to “regulatory dark ages,” criticizing the SEC’s enforcement-led approach and calling this the last realistic legislative window until at least 2030. The Senate Banking Committee has already advanced the bill, but she argued that securing full floor approval is a separate hurdle.
