BINGX CARD TERMS & CONDITIONS
1. Introduction
These Terms and Conditions (the "Agreement") govern your access to and use of the BingX Card program (the "Program") operated by the BingX Group (hereinafter, “BingX”, “we”, “our”, and “us”), including any virtual or physical payment card issued under the Program (the "Card").
The Card is issued by the applicable card issuer (the "Card Issuer") pursuant to a licence granted by VISA. VISA and the VISA logo are registered trademarks of Visa International Service Association and are used under licence.
By applying for, activating, accessing, or using a Card, you acknowledge that you have read, understood, and agree to be bound by this Agreement, as well as the BingX Customer Agreement governing your BingX account (your "BingX Account"), which includes your spot wallet, funding wallet, fiat wallet, sub-accounts, and any digital asset balances maintained within the BingX ecosystem.
The Program allows you to use eligible USDT balances held in your BingX Account to fund Transactions made using the Card, including purchases of goods and services, online payments, and cash withdrawals where permitted
2. Eligibility
2.1 To apply for a Card and participate in the Program, you must be:
(a) at least 18 years of age;
(b) reside in supported countries and regions,
(c) maintain a BingX Account in accordance with the BingX Customer Agreement;
(d) satisfy any eligibility requirements notified by us from time to time; and
(e) accept such other terms and conditions as may be implemented by BingX, the Card Issuer and the Card network rules that may be applicable to you.
Notwithstanding the foregoing, we reserve the right to reject any application at our sole discretion.
2.2 Upon approval, a virtual Card may be issued. The Card is a debit card only and does not provide credit, overdraft, or lending facilities. It is not a bank account.
2.3 Please note that we only offer physical Cards to select customer. Please contact our Customer Support team should you wish to check on your eligibility for such Card. If you receive such physical Card, you must sign the signature strip on the back of the Card as soon as you receive it and then follow the instructions provided to activate it.
2.4 You must set and maintain a secure PIN (and any other authentication methods required, including OTP, biometric verification, or 3DS authentication).
3. FUNDING AND SETTLEMENT
3.1 The Card is a USDT-denominated debit card. Transactions are funded from eligible USDT balances maintained in your BingX Account. By using the Card, you authorize BingX and the Program to reserve, debit, transfer, deduct, or otherwise utilize eligible USDT balances in your BingX Account to settle Transactions and any related amounts, including:
(a) Transaction amounts;
(b) fees and charges;
(c) FX conversion costs;
(d) authorisation holds;
(e) refunds and reversals;
(f) chargebacks;
(g) compliance or regulatory obligations.
3.2 For the purposes of the Program, only USDT balances designated by BingX as eligible for Card funding may be used to settle Transactions. BingX may exclude balances that are subject to open orders, staking, lending, earn products, lock-up arrangements, margin requirements, compliance restrictions, operational holds, or any other restriction determined by BingX.
3.3. Without limiting any other rights available to BingX, where any amount becomes due and payable by you in connection with the Program, BingX may deduct, set off, or recover such amount from any assets or balances maintained by you within the BingX ecosystem to the extent permitted by applicable law.
4. CARD USAGE
4.1 You may use the Card for purchases, online transactions, and withdrawals where supported (each, a “Transaction”). You must not use the Card for unlawful purposes or in violation of sanctions, regulatory requirements, or Network rules. BingX may restrict merchant categories at its discretion.
4.2 Withdrawals are only supported if for users that have been issued physical Cards – in such instance, you can use the physical Card with your PIN to withdraw cash from ATMs and bank counters, as applicable. A withdrawal fee may apply to such withdrawals.
4.3 You must always ensure that you an available balance in your BingX Account for each Transaction you authorize (including value added tax and other taxes, duties and applicable fees) ("Available Balance" means the amount of eligible USDT available for use through the Program after taking into account pending Transactions, authorization holds, fees, reserves, chargebacks, disputes, compliance restrictions and any other amounts determined by BingX to be unavailable for Card funding). If the Available Balance is insufficient to support a Transaction, the Transaction will be declined.
4.4 If for any reason a Transaction is carried out but its amount exceeds the Available Balance, you must pay us the deficit immediately. Without limiting any other rights available to BingX, BingX may terminate this Agreement and deduct, set off, recover, or apply any assets or balances maintained by you within the BingX ecosystem toward satisfaction of such deficit, to the extent permitted by applicable law to recover any such deficit.
4.5 There are certain circumstances where you may be required to have an Available Balance greater than the value of the Transaction you wish to make. However, you will only be charged for the actual and final value of the Transaction (for example, when making hotel or car rental reservations). In the event that a Merchant has prior authorization on Your Card, You may not access the relevant funds until the Transaction is completed or, if sooner, up to a period of 30 days. BingX has no control over the amount or duration of any authorization hold imposed by a merchant, acquiring bank, Card Network, or Card Issuer and shall not be liable for any resulting reduction in your Available Balance.
4.6 We reserve the right to decline a Transaction, place restrictions on Your Card, or apply special security procedures with respect to Transactions if:
(a) You do not have an Available Balance for the Transaction attempted;
(b) The Transaction will take You over the Card limits which can be found in the Fees and Limits Schedule to this Agreement.
(c) To protect the security of your Card and/or BingX Account;
(d) We believe a transaction is unauthorized, illegal, or at high risk of being unauthorized or illegal;
(e) We reasonably believe the transaction would be in breach of the Fees and Limits Schedule to this Agreement or this Agreement;
(f) The transaction and applicable fees would cause Your Account to go into a negative balance;
(g) such other situations which we deem in our discretion, may be in breach of this Agreement, the Customer Agreement, Card Network Rules or such other terms and conditions applicable to the Program.
5. FEES AND LIMITS
Applicable Fees and Limits
5.1 Your use of the Card is subject to applicable fees, charges, spending limits, withdrawal limits, transaction limits, and other restrictions imposed by BingX, the Card Issuer, payment networks, service providers, or applicable law.
5.2 Details of the fees and limits applicable to the Program are available in the BingX Card FAQ, Fees and Limits Schedule, and through the BingX website, mobile application, or other interfaces made available by BingX from time to time.
5.3 BingX may also provide real-time information regarding your Card usage, including applicable limits, available spending capacity, fees, transaction history, and remaining usage allowances through the Program interface. Such information may be presented through dashboards, progress indicators, notifications, account summaries, or similar functionality. For example, where a spending limit applies to your Card, BingX may display your current usage against the applicable limit (e.g., 3,000 / 5,000) for informational purposes.
Responsibility to Review Fees and Limits
5.4 You are responsible for reviewing the fees, limits, and restrictions applicable to your Card before initiating a Transaction.
5.5 The fees and limits displayed through the BingX website, mobile application, or other Program interfaces are provided for convenience only and may be subject to processing delays, technical limitations, pending Transactions, authorization holds, chargebacks, reversals, or other adjustments.
Changes to Fees and Limits
5.6 BingX may amend, introduce, remove, suspend, or replace any fee, limit, restriction, or Program parameter at any time.
5.7 Where reasonably practicable, BingX will notify you of material changes through the BingX website, mobile application, email, push notification, the BingX Card FAQ, the Fees and Limits Schedule, or any other communication channel determined by BingX.
5.8 Notwithstanding the foregoing, BingX may implement immediate changes without prior notice where reasonably necessary to comply with applicable law, Card Network Rules, regulatory requirements, fraud prevention measures, security requirements, operational needs, or risk management considerations.
5.9 Your continued use of the Card following any such change constitutes your acceptance of the revised fees, limits, restrictions, or Program parameters.
6. REWARDS AND PROMOTIONS
6.1 BingX may, from time to time, offer rewards, rebates, cashback, points, loyalty benefits, promotional incentives, or other benefits in connection with the Program.
6.2 Eligibility for any such rewards, rebates, cashback, points, loyalty benefits, promotional incentives, or other benefits shall be subject to such terms and conditions as BingX may specify from time to time.
6.3 Unless otherwise expressly stated, BingX may amend, suspend, withdraw, reverse, cancel, or modify any rewards, rebates, cashback, points, loyalty benefits, promotional incentives, or other benefits at any time, including where BingX reasonably determines that:
(a) an error has occurred;
(b) abuse, fraud, gaming, or suspicious activity is suspected;
(c) a Transaction is reversed, refunded, charged back, or cancelled; or
(d) such action is otherwise necessary to comply with applicable law, Card Network Rules, or Program requirements.
7. KEEPING YOUR ACCOUNT, CARDS, AND PIN SAFE
7.1 You are solely responsible for maintaining the confidentiality and security of your Card, Card credentials, BingX Account credentials, authentication codes, and any other information used to access or authorize Transactions. Whilst we may assist you in terms of any security breach, we shall not be liable for any losses arising out of such breach.
7.2 Keep your PIN safe by memorizing it, never disclosing it to anyone, or by letting anyone see you enter it. We recommend you do not write it down. If you do write Your PIN down or disclose it to any other individual, you may be held liable for any unauthorized or fraudulent transactions made using Your Card.
7.3 You should check the recent transactions and monitor the Transaction history of your Card regularly. If You do not recognize a Transaction, then report it immediately.
8. REPORTING UNAUTHORIZED OR DISPUTED TRANSACTIONS
8.1 If You believe that any of the Transactions on your Card were unauthorized or incorrectly charged to the Card, you must notify Customer Service as soon as you become aware of the same.
8.2 Unless we reasonably suspect fraud, misuse, or a breach of this Agreement, the BingX Customer Agreement, applicable Card Network Rules, or any other terms and conditions applicable to the Program, we will investigate any reported unauthorized or incorrectly executed Transaction and, where appropriate, assist you in seeking a refund, reversal, correction, or chargeback in accordance with applicable law, Card Network Rules, and the policies of the Card Issuer.
8.3 Where we determine that an unauthorized or incorrectly executed Transaction has occurred and you are entitled to reimbursement under applicable law, Card Network Rules, or Card Issuer requirements, we will credit your BingX Account with the relevant amount within a reasonable period following completion of our investigation.
8.4 Any refund, reversal, reimbursement, or provisional credit provided to you may be reversed if we subsequently determine that the Transaction was authorized, correctly executed, fraudulent, disputed in bad faith, or otherwise not eligible for reimbursement.
7.5 Please note that refunds are not guaranteed and remain subject to applicable law, Card Network Rules, merchant dispute procedures, evidentiary requirements, and the determination of the Card Issuer and/or the relevant payment network
9. APPLICABLE LAW
9.1 This Agreement is governed by the laws of [ ] .
9.2 In the event of any dispute relating to this terms and conditions or such other disputes relating to your use of the Card, you agree that such dispute shall be negotiated between the parties. In the event that the parties are unable to reach a conclusion as to a dispute within thirty (30) days from the date which the dispute is submitted by one party to the other, then the parties agree that such dispute shall be finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the SIAC Rules then in force.
9.3 Any delay or failure to exercise any right or remedy under this Agreement by the Program shall not be construed as a waiver of that right or remedy or preclude its exercise at any subsequent time.
9.4 The Program and associated Card is a payment service product and not a deposit or credit or banking product and as such is not governed by any compensation scheme.
9.5 If any provision of this Agreement is deemed unenforceable or illegal, the remaining provisions will continue in full force and effect.
9.6 If any part of this Agreement is inconsistent with any regulatory requirements, then we will not rely on that part but treat it as if it did actually reflect the relevant regulatory requirement. If we need to make operational changes before we can fully comply with the new regulatory requirement, we will make those changes as soon as reasonably practical.
9.7 You may not assign or transfer any of your rights and/or benefits under this Agreement and you shall be the sole party to this Agreement. You will remain liable until all Cards issued to you are cancelled or have expired and all sums due under this Agreement have been paid by you in full.
10. SUSPENSION, RESTRICTION AND TERMINATION
10.1 Without prejudice to any other rights available to BingX, the Card Issuer, the Program manager, or the applicable Card Network, we may suspend, restrict, limit, deactivate, decline Transactions on, or terminate your Card or access to the Program at any time, with or without prior notice, if we reasonably determine that:
(a) such action is required to comply with applicable law, regulation, court order, sanctions requirement, regulatory guidance, Card Network Rules, or a request from a competent authority;
(b) you have breached this Agreement, the BingX Customer Agreement, any applicable policy, Card Network Rule, or any other terms governing your participation in the Program;
(c) we reasonably suspect fraud, money laundering, terrorist financing, sanctions violations, account compromise, unauthorized activity, suspicious activity, or any other unlawful conduct;
(d) your BingX Account is suspended, restricted, frozen, terminated, or otherwise unavailable for use;
(e) you fail to provide information or documentation requested by BingX, the Card Issuer, or any competent authority;
(f) we receive a request, instruction, or direction from the Card Issuer, payment processor, Card Network, banking partner, Program manager, regulator, governmental authority, or other service provider involved in the operation of the Program;
(g) your use of the Card presents an unacceptable legal, regulatory, financial, operational, reputational, or security risk; or
(h) we otherwise determine, acting reasonably, that suspension, restriction, limitation, deactivation, or termination is necessary to protect BingX, the Program, other users, or third parties.
10.2 You may terminate your participation in the Program at any time by contacting Customer Support and completing any required account closure, verification, repayment, or Card cancellation procedures.
10.3 Termination of the Program does not affect any rights, obligations, liabilities, fees, chargebacks, disputes, investigations, or Transactions that arose prior to termination.
10.4 Where your Card or access to the Program is suspended, restricted, limited, deactivated, or terminated:
(a) you may be unable to initiate or complete Transactions;
(b) BingX may decline any Transaction or instruction relating to the Card;
(c) any rewards, benefits, promotions, or Program features may be suspended or forfeited;
(d) BingX shall not be obliged to honour, complete, re-submit, re-authorize, or reinstate any Transaction, authorization, exchange rate, reward, benefit, or promotional offer that would otherwise have been available had such suspension, restriction, limitation, deactivation, or termination not occurred; and
(e) BingX may take any action reasonably necessary to recover outstanding amounts owed in connection with the Program.
11. DIGITAL ASSET RISKS
11.1 The Program relies upon the availability of eligible digital assets, including USDT, within your BingX Account.
11.2 You acknowledge and accept that digital assets are not legal tender and may be subject to technological, operational, liquidity, market, legal, regulatory, custodial, issuer-related, cybersecurity, or other risks.
11.3 Without limiting the foregoing, USDT or any other digital asset may fluctuate in value, fail to maintain any intended peg, become unavailable, experience reduced liquidity, be subject to redemption restrictions, or cease to be supported by BingX, the Card Issuer, or other service providers.
11.4 BingX shall not be liable for any loss, inability to use the Card, declined Transaction, delay, interruption, or other consequence arising directly or indirectly from any event described in this Section.
12. INDEMNITY
12.1 To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BingX, its affiliates, shareholders, directors, officers, employees, agents, contractors, service providers, Card Issuers, Program managers, banking partners, payment processors, licensors, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, actions, proceedings, investigations, liabilities, losses, damages, judgments, penalties, fines, costs, and expenses (including reasonable legal fees and professional costs) arising out of or in connection with:
(a) your use of the Program or the Card;
(b) your breach of this Agreement, the BingX Customer Agreement, or any applicable policy;
(c) your breach of any applicable law, regulation, sanctions requirement, or Card Network Rule;
(d) any information, instruction, representation, or document provided by you to BingX;
(e) your failure to maintain the security of your Card, PIN, security credentials, authentication devices, or BingX Account;
(f) any fraud, negligence, misconduct, unauthorized activity, or unlawful conduct by you;
(g) any dispute between you and a merchant, service provider, or third party; or
(h) any exercise by BingX of its rights under this Agreement.
12.2 The obligations under this Section shall survive suspension, termination, or expiration of this Agreement.
13. LIMITATION OF LIABILITY
13.1 To the fullest extent permitted by applicable law, neither BingX nor any of its affiliates, Card Issuers, Program managers, service providers, banking partners, payment processors, or licensors shall be liable for any indirect, incidental, special, punitive, exemplary, consequential, or similar damages, including loss of profits, loss of business, loss of opportunity, loss of goodwill, loss of data, or loss of anticipated savings, whether arising in contract, tort, negligence, statute, or otherwise.
13.2 BingX shall not be liable for any loss arising from the refusal, failure, delay, restriction, interruption, suspension, or decline of any Transaction, regardless of the reason for such refusal or decline.
13.3 BingX is not responsible for the quality, safety, legality, delivery, performance, or suitability of any goods or services purchased using the Card. Any dispute regarding goods or services purchased with the Card must be resolved directly with the relevant merchant, subject to any applicable chargeback rights.
13.4 BingX accepts no responsibility where a merchant refuses to accept the Card, imposes restrictions on Card usage, fails to process a refund, fails to release an authorization hold, or otherwise declines to transact with you.
13.5 BingX shall not be liable for any reduction in your Available Balance arising from authorization holds imposed by merchants, acquirers, Card Networks, or the Card Issuer.
13.6 While BingX will use reasonable efforts to maintain availability of the Program, BingX does not guarantee uninterrupted, secure, error-free, or continuous operation of the Program. Access to the Program may be interrupted due to maintenance, upgrades, technical failures, force majeure events, third-party failures, regulatory requirements, security incidents, or circumstances beyond BingX's reasonable control.
13.7 Except as expressly provided in this Agreement and to the fullest extent permitted by applicable law, the Program and the Card are provided on an "as is" and "as available" basis without any representation, warranty, or guarantee of any kind, whether express, implied, statutory, or otherwise.
13.8 To the extent that BingX is found liable notwithstanding the foregoing provisions, BingX's aggregate liability arising out of or in connection with the Program shall not exceed the total fees paid by you in connection with the Program during the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law.
14. General
Amendments
14.1 BingX may amend, modify, supplement, replace, or update this Agreement at any time. Any such changes may be notified through the BingX website, application, email, FAQ, Fees and Limits Schedule, or any other communication channel determined by BingX. Your continued use of the Card or participation in the Program following the effective date of any amendment constitutes your acceptance of the revised Agreement.
Entire Agreement
14.2 This Agreement, together with the BingX Customer Agreement and any documents expressly incorporated by reference, constitutes the entire agreement between you and BingX in relation to the Program.
Severability
14.3 If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Assignment
14.4 BingX may assign, transfer, novate, subcontract, or otherwise deal with any of its rights and obligations under this Agreement without your consent. You may not assign or transfer any of your rights or obligations under this Agreement without BingX's prior written consent.
Taxes
14.5 You are solely responsible for determining whether any taxes apply to your use of the Program, the Card, any Transactions, refunds, rewards, conversions, or any related activity.
You are responsible for reporting and paying any taxes arising from your participation in the Program and should seek independent professional advice where appropriate.
BingX does not provide tax, legal, accounting, or investment advice and accepts no responsibility for your tax obligations.
Survival
14.6 Any provision of this Agreement which by its nature is intended to survive termination shall survive termination of this Agreement, including provisions relating to indemnities, liability, dispute resolution, taxes, investigations, chargebacks, recoveries, and outstanding obligations.
